Carbon monoxide kills

Every year about 30 people die and an additional 200 people suffer from carbon monoxide poisoning caused by gas appliances and flues not properly installed or maintained.

In addition there were 1,212 injuries and 168 fatalities in the 5 years to 2003 as a result of incidents relating to the supply of gas.

Annual servicing of your appliances and pipe-work reduces the risk of breaking the law and minimizes the risk of gas leaks and carbon monoxide poisoning.


Landlords with residential accommodation

Landlords must ensure that installation pipe-work, gas appliances and flues provided for tenants are maintained in a safe condition and that an annual safety check is carried out on each appliance and/or flue that Landlords provide for tenants' use.

Under the 1998 regulations Landlord's duties apply to 'relevant premises' this covers residential properties occupied for residential purposes under either a licence, a tenancy agreement for a set term or a lease.


Note: Corgi states that an appliance service alone will not necessarily meet the information recording requirements of a landlord's safety check, NOR will the annual landlord's safety check alone be sufficient to provide effective maintenance.

Basic duties in addition to above:

  • Ensure maintenance and annual safety checks are carried out by a Corgi registered installer
  • Have a safety check carried out on all appliances and flues annually or within 12 months before the start of a new tenancy
  • Keep a record of each safety check for 2 years
  • Issue a copy of the Landlord's Gas Safety Record or equivalent Corgi installers safety check report to the tenant within 28 days of the check or to a new tenant before they move in.
  • A safety check record must have taken place within 12 months before the start of the new tenancy/lease date unless the appliances have been installed for less than 12 months they should then be checked within 12 months of the installation date

Severe penalties for non-compliance can be imposed and deaths can result in manslaughter charges for landlords and agents. This has resulted in prison sentences and non compliance means courts can also impose unlimited fines. Failure to comply with the regulations may invalidate your property insurance as well as lead to claims for civil damages - awards in these cases have proved to be very high indeed.
